These General Conditions of Sale ("Agreement"), which are a legal and binding document for the customer ("Customer"), have as their object the purchase of EURPCB services made remotely via the telematic network on the website eurpcb.com, belonging to Nuvolaria Srl, based in Italy in Campobasso (CB), via Orefici 45. Each purchase transaction will be governed by the provisions of dlgs. 185/99, dlgs. 206/05; the information directed to the conclusion of the contract will be submitted to art. 12 of dlgs. 70/03 and, as regards the protection of confidentiality, will be subject to the legislation referred to in dlgs. 196/03.

EURPCB Services

eurpcb.com ("Site") is a platform developed and managed by Nuvolaria S.r.l. ("Nuvolaria") that allows Customers to purchase the design, prototyping and production of pcb boards. Your use of the Site and the Services is governed by this Agreement.

Use of the Site requires the mandatory activation of a personal and unique user account ("Account"), for the management of business relationships and the use of the Services.

Conclusion of the contract and acceptance of the general conditions of sale

The contracts for the sale of the services on the Site are considered concluded at the moment when the purchase order is received by the Customer at Nuvolaria and the latter accepts it. Nuvolaria will promptly send the Customer receipt of the purchase order made by the Customer. The Customer, by sending his purchase order online, declares that he has read and accepted these general terms and conditions and undertakes to observe and respect them in his relations with Nuvolaria.

Processing of personal data

Nuvolaria pursuant to art. 13 of Legislative Decree 196/2003 informs that personal data and tax acquired also verbally in reference to the business relationships established, provided directly by the data subjects, or otherwise acquired within the company’s business, shall be processed in compliance with the aforementioned legislation, including the obligations of confidentiality set out therein.

In relation to the above, the rights referred to in article 7 dlgs may be exercised. 196/2003.

Customer's obligations

The Customer is obliged, before submitting his purchase order, to carefully read these general conditions of sale. The submission of the purchase order implies their full knowledge and acceptance.

The Customer is obliged, finally, once the online purchase procedure has been completed, to print and keep these general conditions of sale, already viewed and accepted during the conclusion of the contract.

At the time of purchase, the Customer creates an Account that will be associated with a unique username and password ("Account Credentials"). This Account is related to the commercial aspect of the Agreement

The Customer is obliged to take all necessary measures to ensure that the Account Credentials are subject to strict confidentiality and the Customer assumes responsibility for any loss or damage to Nuvolaria and/or third parties as a result of failure to comply with the aforementioned confidentiality. The Customer undertakes not to disclose the Account Credentials and the information accessible through them and undertakes not to allow access to the eurpcb.com website, and services to others through the use of your Account Credentials or in any way through your account. If you become aware of unauthorized access to your Account, you must change your password and notify us immediately at info@eurpcb.com.

The Customer is obliged to provide Nuvolaria with real and accurate information when creating the Account (and each time it updates its data) and, in order to ensure the security of the Account, undertakes to:

• not provide false information;
• do not create false or duplicate Accounts;
• update your personal data whenever requested, in order to comply with the provisions of this Agreement;
• not to share or transfer Account Credentials;
• not to adopt as Username or ID for your Account names that violate the law or the rights of third parties (in this case Nuvolaria will have the right to suspend the registration or the Account until the problem is resolved).

Customer's duties

The Customer undertakes not to:

• transfer or resell the Services or your right to use the Site to others;
• tamper or operate on the Site without the intervention and authorization of Nuvolaria;
• use the Site and the Services if the Account has been temporarily or permanently suspended;
• use the Site to create or embed other Nuvolaria-related datasets to be used for a similar or identical service;
• provide Nuvolaria with false, inaccurate, misleading data or data which give rise to negative consequences for third parties;
• transfer the Account or communicate the Account Credentials to third parties without the prior written consent of Nuvolaria;
• spreading viruses, malware or any other technology intended to harm the Site, other Customers' devices, violate the rights of Nuvolaria or other Customers or in any way to hinder or disturb the use of the Site by other Users;
• copy, modify or disseminate the content of the Site or information owned by Nuvolaria and/or others (except as provided by the terms of the open source licenses applicable to the software, if accessible through the Site);
• use any mechanism, software or procedure that may interfere with the proper functioning of the Site;
• circumvent the tools provided by Nuvolaria to ensure the security of the Site and prevent intrusion or access by unsolicited automatic users (for example, robots, spam, spiders);
• upload to the Site or in any way communicate or send through the Site to other Customers content (text or graphic content or any other type) that is offensive, vulgar, violent, false, damaging to the image of Nuvolaria or contrary to the law, or in violation of the rights of third parties or the open source licenses used;
• copy, download, duplicate, distribute, disseminate or in any way use - even partially - images, distinguishing marks, texts and content belonging to Nuvolaria or otherwise present on the Site;
• export any information outside the Site, except as expressly provided in this Agreement and subject to the rights granted by the open source licenses used.

If Nuvolaria considers, in its sole discretion, that the Customer has engaged in one or more conduct that may cause technical problems or legal liability or that violates the provisions of the Agreement, Nuvolaria may, without prejudice to other remedies, limit, suspend or terminate the availability of the Services and/or Account, and take technical and legal measures - including the removal of illegal content - in order to prevent the Customer from using the Services or in contravention of the law or license agreements that the Customer is obliged to comply with.

The Customer undertakes to indemnify and hold Nuvolaria harmless, as well as its directors, employees, managers, agents and any subsidiary and/or controlling company of Nuvolaria, from any damage resulting from the violation by the Customer, the terms and conditions of this Agreement.
